These terms govern your purchase and use of Enduring Stories. By buying or using our service, you agree to them. Please read them alongside our Privacy Policy. If anything is unclear, write to us before you purchase.
Enduring Stories is a service operated by MILC Holdings Pty Ltd (ABN 68 163 567 048) ("Enduring Stories", "we", "us", "our"), based in Queensland, Australia. We provide a service that captures a guided life-story interview and produces it into a private audio recording, transcript and, depending on the tier purchased, written materials and a hosted heirloom page. "You" means the person purchasing or using the service.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
You must be at least 18 years old and able to enter into a binding contract to purchase. If you arrange for someone else to be interviewed, you confirm you are authorised to do so and that the arrangements described below regarding their consent are met.
The interview is recorded, and recording is essential to the service. Each interview begins with a spoken step in which the person being interviewed confirms they are happy to be recorded.
If you are arranging an interview for someone else, you are responsible for ensuring that person knows they will be recorded and is willing to take part. If a person declines to be recorded, the interview will not proceed.
Hosting of your heirloom page is included for three years from delivery, and can be extended. You can download your audio and transcript from delivery and keep your own copies indefinitely. We strongly encourage you to do so. Near the end of the hosting period we will contact you with options to extend or to rely on your downloaded copies.
You and your family own your content. The recordings, transcript, photographs and the written materials we produce from your interview are yours to keep, share with your family, and pass down.
We own the Enduring Stories platform, website, brand, and the interviewer we have built, including the underlying software and methods. Nothing in these terms transfers our intellectual property to you. We grant you the right to use the heirloom we deliver for your own personal and family purposes.
We will not publish, sell, or use your content as marketing material without your explicit permission.
30-day money-back guarantee. If, for any reason, the service is not right for you, write to us within 30 days of purchase and we will refund you in full, whether or not the interview has taken place and whether or not the deliverable is finished.
If the person to be interviewed passes away before any recording has been made, we will provide a full refund on confirmation of the situation. If part of an interview was completed, you may choose a refund, or we will produce the heirloom from what was captured with the same care as a finished recording.
These guarantees are in addition to your rights under the Australian Consumer Law, which may entitle you to a repair, replacement or refund in other circumstances.
You agree not to use the service unlawfully, to record a person without the consent described above, to attempt to gain unauthorised access to our systems or others' heirlooms, or to interfere with the operation of the service. We may suspend or end access where these terms are seriously or repeatedly breached.
We provide the service with reasonable care and skill. To the extent permitted by law, and subject always to the consumer guarantees under the Australian Consumer Law that cannot be excluded:
Because the recording of a living voice can be irreplaceable, we strongly encourage you to download and keep your own copies of your audio and transcript as soon as they are delivered.
Our handling of personal information is described in our Privacy Policy, which forms part of these terms.
We may update these terms from time to time. When we do, we will change the "last updated" date above. The terms that applied at the time of your purchase govern that purchase.
These terms are governed by the laws of the State of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of Australia. If you are a consumer in another country, you may also have the benefit of mandatory protections under the law of the place where you live.
